Terms of Use

These Terms govern your use of the SofaList app (the "App") and the website sofalist.app (the "Website"), published by Applications Macareux, a sole proprietorship registered in Quebec, Canada ("we", "us"). By using the App you agree to these Terms. Our Privacy Policy explains how we handle information.

Effective date: [launch date]
Last updated: [date]

1. The short version

  • SofaList helps you keep lists of films and shows you want to watch, are watching or have watched. Your lists are stored on your phone.
  • Some features use artificial intelligence (AI) and public sources such as Wikidata and Wikipedia. They can be wrong.
  • The App is free to use, with limits. SofaList Premium removes them, and is sold through Google Play.
  • You must be 18 or older to use the App.
  • Nothing in these Terms takes away rights you have under the consumer protection laws where you live.

2. Who can use the App

You must be at least 18 years old. The App's AI features rely on services that may not be used by minors.

3. Your licence to use the App

We give you a personal, non-exclusive, non-transferable licence to install and use the App on devices you own or control. You may not:

  • copy, resell or redistribute the App;
  • reverse engineer it, except as the law allows;
  • use our server outside the App, send it automated or excessive requests, or try to get around its limits;
  • use the App to break the law or anyone's rights.

4. Your lists, notes and photos

What you put in the App (lists, notes, photos) is yours and stays on your phone. We do not receive it, so we cannot recover it for you. Keep a backup: the App's "Back up now" saves a file with your lists and photos where you choose, and Android's own backup can carry your lists (not your photos). See the Privacy Policy.

You are responsible for the photos you take or add. Take photos only of things you are allowed to photograph, and avoid photographing people or personal documents. Photos you scan or take in the App are sent, reduced, to identify the title and find its artwork, as the Privacy Policy explains; you give us permission to do this for you.

5. AI features and information accuracy

The App uses AI (Google's Gemini) to identify titles from photos, to find artwork in a photo, and to write short summaries and mood tags. Title information comes from Wikidata and Wikipedia, which anyone can edit.

  • AI and public sources can be wrong: a scan may name the wrong title, and a summary may contain mistakes or reveal more of the story than you want. Check before you rely on it.
  • Summaries are adapted from Wikipedia and shared under the Creative Commons Attribution-ShareAlike licence (CC BY-SA), as credited in the App. Wikidata content is in the public domain (CC0).
  • If something is offensive, wrong or a spoiler, use "Report" on the summary. We review reports and may correct or remove the content; we are not required to make every change requested.

6. Free use and SofaList Premium

Free. The App is free to use with a limit on the number of titles you can keep and a small monthly allowance of AI features (scans, photo cropping and summaries). The current limits are shown in the App. You can always view, move, remove and back up your titles, even above the limit.

Premium. SofaList Premium removes the title limit and gives you the AI features with a fair-use limit (a generous monthly ceiling that protects the service from abuse and that normal use does not reach). Premium is offered as:

  • Monthly or yearly subscription. It renews automatically at the end of each period until you cancel. The price and period are shown by Google Play before you buy. You can cancel at any time in Google Play (Subscriptions) or with Manage subscription in the App; you keep Premium until the end of the period you paid for. If we change the price, Google Play tells you before the new price applies, and you can cancel before it does.
  • Lifetime. A one-time purchase that gives you Premium for as long as SofaList is offered, not for your lifetime or ours. See section 7 for what happens if we stop offering SofaList or its online features.

There is no free trial at launch.

Payment and refunds. Google Play processes all payments, under Google Play's terms. Refunds are requested from Google Play under its refund policy. This does not limit any refund or cancellation right you have under the law where you live.

Premium on a new phone. Premium is linked to the Google account you bought it with, and comes back when you install the App on a phone signed in to that account.

7. Availability and changes to the App

We work to keep the App and its online features available, but we cannot promise they will always work: they depend on our server and on outside services (Cloudflare, Google, Wikimedia) that can be slow, change or stop.

We may change, add or remove features. If we ever decide to stop SofaList's online features (search, scans, summaries), we will announce it in the App at least 90 days before. The App is designed so that your lists, adding titles by hand, and backups keep working on your phone after that, and Premium keeps removing the title limit.

8. Third-party content and trademarks

Film and show titles, names and marks belong to their owners. Buttons that open IMDb, Rotten Tomatoes, Metacritic, Wikipedia or a Google search link to those sites; we are not affiliated with them, and their own terms apply. SofaList is not endorsed by any studio, streaming service or rating site.

9. Our content

The App, the Website and their design, text, code, name and icon belong to us or our licensors (except the Wikipedia and Wikidata content described in section 5). You may share links to the Website.

10. Warranties

We provide the App with care, but as it is and as available, without promising that it will be free of errors or interruptions. If you are a consumer in Quebec, or anywhere the law gives you warranties that cannot be excluded, nothing in these Terms limits those warranties.

11. Liability

To the extent the law allows, we are not responsible for indirect losses (such as lost data you did not back up, or missed shows), or for losses caused by outside services or by mistakes in AI or public content. Nothing in these Terms excludes or limits our liability for our own fault where the law does not allow it, including under Quebec's Consumer Protection Act.

12. Ending these Terms

You can stop using the App at any time by uninstalling it (cancel any subscription in Google Play first; uninstalling does not cancel it). We may suspend access to our online features for anyone who breaks section 3, for example by abusing our server.

13. Changes to these Terms

We may change these Terms, for example when we add a feature or the law changes. We will post the new version on the Website with its date and announce important changes in the App. If a change affects an essential part of your Premium purchase (such as its price or what it includes), we will tell you at least 30 days before it applies, and you can refuse the change by cancelling, as Quebec law provides.

14. Governing law and disputes

These Terms are governed by the laws of Quebec and the federal laws of Canada that apply there. If you are a consumer, you may also rely on the mandatory consumer protection laws of the place where you live, and you can bring a claim before the courts of your place of residence where the law gives you that right. Please contact us first; most problems can be solved by email.
